New rules require more insulation than older models and thus make new ones bigger. They are already about as efficient as possible (about 90%).

Really with an electric hot water heater it can be considered 100% efficient as all the heat the elements generate goes into heating the water. Nothing goes up a chimney or vent.

A better water heater would have more insulation like Ray mentioned.

A few yrs ago I replaced our old 52 gallon water heater with the same brand but only 40 gallons. Both units were virtually the same overall size. I'd be surprised if you can find a smaller 40 gallon heater although they do make them narrow/tall or short/fat along with the regular size.

Well I kind of thought that but figured it wouldn't hurt to through it out there and see if I may have missed something.
